MVRcheck Fleet Register Terms of Use

1. Agreement to These Terms

These Terms of Use govern access to and use of MVRcheck Fleet Register, including its vehicle-management, accident-register, document-storage, reporting, import, export, notification, billing, and administrative features. Fleet Register is provided by MVRcheck.com ("MVRcheck"). By accessing or using Fleet Register, the user and the subscribing business organization agree to these Terms. Fleet Register is also governed by the MVRcheck Master Services Agreement available at mvrcheck.com/msa and any applicable order form, subscription agreement, service addendum, or written pricing agreement. If these Terms conflict with the Master Services Agreement, the Master Services Agreement controls. The MSA states that creating an account, clicking acceptance, submitting an order, or using the services constitutes agreement to its terms.

2. Business Use Only

Fleet Register is intended exclusively for authorized business, fleet, safety, insurance, claims, and regulatory recordkeeping purposes. Users may not use Fleet Register for:

A person using Fleet Register represents that:

MVRcheck may require account approval, verification, subscription enrollment, and acceptance of additional agreements before access is activated. Public self-registration does not guarantee account approval.

Each user must maintain an individual account unless MVRcheck expressly permits another arrangement. Users must:

MVRcheck may suspend or restrict access when it reasonably believes credentials have been compromised or activity creates a security, legal, billing, regulatory, or operational risk.

5. Authorized Users and Roles

Subscriber administrators may invite users and assign roles, permissions, locations, and access levels. Subscriber is responsible for determining which users may:

6. Subscriber Data

"Subscriber Data" means information, records, files, documents, images, and other content entered, uploaded, imported, or generated by or for Subscriber through Fleet Register. As between MVRcheck and Subscriber, Subscriber retains its rights in Subscriber Data. Subscriber grants MVRcheck and its authorized service providers a limited right to host, process, transmit, copy, back up, display, and otherwise use Subscriber Data as reasonably necessary to:

7. Subscriber Responsibilities for Data

Subscriber represents that it has a lawful basis and all necessary authority to collect, upload, store, use, and disclose Subscriber Data. Subscriber is responsible for:

Fleet Register provides tools for organizing vehicle information, document expirations, accident records, claims information, corrective actions, and supporting documents. MVRcheck does not independently verify:

Fleet Register may generate accident registers, no-accident statements, compliance summaries, and other reports intended to assist subscribers with recordkeeping. Such reports:

10. Imports and Migration

Fleet Register may allow CSV or Excel imports. Subscriber is responsible for:

Spreadsheet exports from legacy systems may not include pictures, attachments, or documents. MVRcheck does not guarantee that any legacy-system export contains all historical data. An import marked "completed" means that the application processed the selected file according to the configured mappings. It does not certify the accuracy or completeness of the imported information.

11. Exports and Downloads

Subscriber may generate PDF, CSV, Excel, print, or packaged exports. Subscriber is responsible for:

Generated download links may expire. MVRcheck is not required to recreate an expired export when the source information is no longer available.

12. Subscription Plans and Billing

Fleet Register may be offered under monthly, annual, custom, complimentary, trial, or manually invoiced plans. Subscription features may depend on:

Payments may be processed through Stripe or another payment processor. Subscriber authorizes applicable recurring charges according to the selected plan and billing interval. Unless otherwise stated in a written agreement:

Subscriber must maintain current payment and billing information. The MSA requires subscribers to pay applicable fees and permits account suspension or termination for specified legal, security, compliance, operational, or payment concerns.

13. Trials and Promotional Pricing

Trial periods, discounts, credits, or promotional pricing may be subject to additional conditions. Unless otherwise stated:

Subscriber may cancel according to the applicable subscription settings, order form, or written agreement. Cancellation may take effect immediately, or at the end of the current billing period. Subscriber remains responsible for exporting all records required for business or compliance purposes before access ends. MVRcheck may suspend, restrict, or terminate access for:

Account cancellation does not require immediate deletion of data. Data may be retained or deleted according to the Privacy Policy, MSA, applicable law, backup schedules, and contractual obligations.

MVRcheck will use commercially reasonable efforts to provide notice of material changes when appropriate. Service may be unavailable because of maintenance, outages, internet failures, third-party systems, emergency security work, or events outside MVRcheck's reasonable control.

18. Third-Party Services

Fleet Register may rely on third-party services, including:

Third-party systems may be unavailable, delayed, modified, or discontinued. MVRcheck does not control independent third-party services and does not guarantee their uninterrupted availability. The MSA also explains that MVRcheck may use independent providers for hosting, communications, support, and other platform functions.

19. Intellectual Property

Fleet Register, including its software, interface, design, workflows, logos, documentation, reports, templates, and underlying technology, is owned by MVRcheck or its licensors and is protected by applicable intellectual-property laws. Subject to payment and compliance with applicable agreements, MVRcheck grants Subscriber a limited, nonexclusive, nontransferable, revocable right to use Fleet Register for its internal authorized business purposes. No rights are granted except those expressly stated.

20. Feedback and Feature Requests

Users may submit ideas, suggestions, or feature requests. MVRcheck may use feedback without restriction or compensation, provided MVRcheck does not acquire ownership of Subscriber's confidential records merely because they are included in a support request. Users should not include confidential or personal information in a public feature-request submission.

21. Confidentiality

Each party must protect non-public information received from the other party and use it only for authorized purposes. Subscriber must treat exported accident records, vehicle records, user information, and documents as confidential where appropriate. Additional confidentiality obligations are contained in the MSA.

22. Disclaimers

FLEET REGISTER IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. MVRcheck does not warrant that:

Fleet Register is a technology and record-management tool. It is not a substitute for legal, regulatory, safety, insurance, accounting, or professional advice.

23. Limitation of Liability and Indemnification

The limitation-of-liability and indemnification provisions in the Master Services Agreement apply to Fleet Register. Nothing in these Terms expands MVRcheck's liability beyond the liability expressly accepted in the MSA.

24. Governing Law and Dispute Resolution

The governing-law, binding-arbitration, delegation, class-action-waiver, and jury-trial-waiver provisions in the Master Services Agreement apply to these Terms and Fleet Register. The current MSA identifies Florida law and provides for arbitration in Duval County, Florida.

25. Changes to These Terms

MVRcheck may update these Terms to reflect changes in:

Notice of material changes may be provided by email, dashboard notice, or website posting. Unless otherwise stated, continued use after the effective date constitutes acceptance of the updated Terms.
